2. User Accounts

To access most features of the service, you must register for an account. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. API Keys & AI Usage (Bring Your Own Key)

Our service allows you to use your own Google Gemini API Key ("BYOK") to access AI features. By using this feature, you acknowledge and agree that:

• You are solely responsible for obtaining, managing, and securing your API keys.
• You are responsible for any costs, usage limits, or quotas associated with your API key as determined by the AI provider (Google).
• Your API key is stored locally on your device and transmitted to our backend only when necessary to process your request. It is not stored in our persistent databases.
• You must comply with the AI provider's Terms of Service and usage policies.

4. User Conduct & Prohibited Content

You agree not to use the Service to generate, store, or share content that:

• Violates any applicable national or international law or regulation.
• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
• Promotes terrorism, hate speech, discrimination, or violence.
• Contains child sexual abuse material (CSAM) or exploits minors in any way.
• Infringes upon the intellectual property rights of others.
• Contains malware, viruses, or any other malicious code.

We reserve the right to terminate your account and delete your data immediately and without notice if you are found to be in violation of these terms.

5. Limitation of Liability & Content Disclaimer

User-Generated Content: Flooou Inc. is a provider of software services and does not own, control, or verify the content created or stored by users. We explicitly disclaim all liability for any content generated, stored, or transmitted by you or other users through the Service. You are solely responsible for your content and the consequences of storing or sharing it.

In no event shall flooou, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

6. Law Enforcement Cooperation

We value your privacy, but we are also committed to safety and the rule of law. We reserve the right to disclose your information, including account details and stored content, to law enforcement authorities or other government officials if we are required to do so by law (e.g., in response to a subpoena, warrant, or court order) or if we believe in good faith that such disclosure is necessary to:

• Prevent imminent physical harm or financial loss.
• Report suspected illegal activity, including but not limited to the storage of CSAM or promotion of terrorism.
• Investigate violations of our Terms of Service.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect.
